DMCA Notice & Takedown Policy

CP Triangle respects the intellectual property rights of others and expects users of cptriangle.com (the "Site") to do the same. This policy explains how to notify us of material on the Site that you believe infringes your copyright, and how the person who supplied that material may respond.

The Site displays real-estate listing content, photographs, and other media supplied through the Internet Data Exchange (IDX) program of Doorify MLS and by third-party brokerages and photographers. We do not create most of this material, and we act on valid infringement notices promptly.

Designated Copyright Agent

CP Triangle has designated the following agent to receive notifications of claimed copyright infringement under the Digital Millennium Copyright Act, 17 U.S.C. § 512(c):

Notices sent to any address other than the designated agent above may not receive a response. This agent must also be registered with the U.S. Copyright Office DMCA Designated Agent Directory for the safe-harbor protections of § 512 to apply.

Filing a Notice of Claimed Infringement

To be effective under 17 U.S.C. § 512(c)(3), your written notice to our designated agent must include substantially all of the following:

  • A physical or electronic signature of the copyright owner, or a person authorized to act on the owner's behalf.
  • Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are covered by a single notice.
  • Identification of the material claimed to be infringing, with enough detail for us to locate it — for listing content, please include the full URL and the MLS number.
  • Your contact information, including address, telephone number, and email address.
  • A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notice is accurate, and — under penalty of perjury — that you are the copyright owner or authorized to act on the owner's behalf.

What Happens After We Receive a Valid Notice

  • We will remove or disable access to the material identified in the notice within a reasonable time.
  • Where the material came from the IDX feed or a third-party brokerage, we will also refer the notice to Doorify MLS or the supplying brokerage, since the source data is outside our control.
  • We will take reasonable steps to notify the party who supplied the material that it has been removed or disabled.

Counter-Notification

If you believe your material was removed or disabled by mistake or misidentification, you may send a written counter-notification to our designated agent under 17 U.S.C. § 512(g)(3), including substantially all of the following:

  • Your physical or electronic signature.
  • Identification of the material that was removed and the location where it appeared before removal.
  • A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which we may be found), and that you will accept service of process from the complaining party or its agent.

If we receive a valid counter-notification, we may restore the removed material in 10 to 14 business days unless the original complaining party notifies us that it has filed an action seeking a court order to restrain the allegedly infringing activity.

Repeat Infringers

CP Triangle will, in appropriate circumstances, disable or terminate access for users who are determined to be repeat infringers.

Misrepresentation

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages, including costs and attorneys' fees. If you are unsure whether material on the Site infringes your rights, consider consulting an attorney before sending a notice.
